These Terms of Use ("Terms") govern your access to and use of FenceFinder.ca ("FenceFinder", "we", "us", or "our"), a free fence contractor matching service for Ottawa homeowners. Please read these Terms carefully before using our website.

1. Acceptance of Terms

By accessing or using FenceFinder.ca, submitting a quote request, applying as a contractor, or otherwise interacting with our service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use FenceFinder.ca. These Terms apply to all visitors, homeowners, contractors, and any other users of the site.

2. What FenceFinder Does

FenceFinder is a free referral and matching service. We connect Ottawa homeowners who need fence installation or repair with pre-screened local fence contractors. Specifically:

• Homeowners submit a project request describing their fence needs
• We match the request with up to 3 contractors from our network based on location, fence type, and availability
• Matched contractors receive the homeowner's contact details and project summary
• The homeowner and contractor communicate directly to arrange quotes and work

3. Terms for Homeowners

By submitting a quote request, you agree that:

• The information you provide is accurate and truthful
• You are the property owner or have authority to arrange fence work at the property
• You consent to your contact information and project details being shared with up to 3 matched contractors
• You are located in the Ottawa area and the project is for an Ottawa property
• You will engage with matched contractors directly and in good faith
• You will not submit duplicate or fictitious quote requests

FenceFinder's service to homeowners is completely free. You are never charged for receiving contractor matches or quotes.

4. Terms for Contractors

Contractors who apply to and participate in the FenceFinder network agree to:

• Provide accurate and complete information in their application, including valid Ontario business registration, WSIB coverage, and liability insurance of at least $2,000,000
• Maintain all required licences, registrations, and insurance throughout their participation
• Respond to matched leads promptly and professionally
• Contact homeowners only for the purpose of providing fence quotes and services
• Not contact homeowners for unrelated marketing, solicitation, or any other purpose
• Honour any quoted prices for a reasonable period
• Comply with all applicable Ontario and Ottawa laws, building codes, and permit requirements
• Not share, sell, or transfer homeowner contact details to any third party

FenceFinder reserves the right to suspend or permanently remove any contractor from the network for breach of these Terms, poor homeowner feedback, misrepresentation, or any conduct that reflects poorly on the FenceFinder service.

5. No Guarantee of Results

FenceFinder does not guarantee:

• That a homeowner will be matched with a contractor (matches depend on contractor availability and coverage)
• The quality, timeliness, pricing, or outcome of any fence work performed by a contractor
• That a contractor will respond to or follow up on a lead
• Any specific number of leads for contractors

All arrangements, agreements, pricing, and contracts are made directly between the homeowner and the contractor. FenceFinder is not a party to these arrangements.

6. Acceptable Use

You agree not to use FenceFinder.ca to:

• Submit false, misleading, or fraudulent information
• Impersonate any person or entity
• Harass, abuse, or harm another user or contractor
• Attempt to gain unauthorized access to any part of the site or our systems
• Scrape, copy, or harvest content or data from FenceFinder.ca
• Use the site for any unlawful purpose or in violation of these Terms
• Interfere with the proper functioning of the website
• Submit spam, duplicate, or test quote requests

We reserve the right to block or ban any user or contractor who violates these Terms or abuses our service.

7. Intellectual Property

All content on FenceFinder.ca — including text, logos, graphics, design, code, and the FenceFinder name and brand — is owned by FenceFinder or its licensors and is protected by Canadian copyright and intellectual property law.

You may not reproduce, copy, distribute, or create derivative works from any content on FenceFinder.ca without our prior written permission, except as permitted by law (e.g., personal, non-commercial use).

8. Disclaimers

FenceFinder.ca is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the site will be uninterrupted, error-free, or secure
• Any warranty regarding the accuracy, completeness, or reliability of any content on the site
• Any warranty regarding the quality or suitability of any contractor in our network

We pre-screen contractors at the time of application, but we do not continuously verify contractor credentials, insurance, or WSIB status. Homeowners are encouraged to independently verify contractor information before entering into any agreement.

9. Limitation of Liability

To the fullest extent permitted by applicable law, FenceFinder and its owners, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use FenceFinder.ca
• Any fence work performed or not performed by a contractor
• Any dispute between a homeowner and a contractor
• Any reliance on information provided through the site or chatbot
• Any unauthorized access to or alteration of your data

Our total liability to you for any claim arising from use of FenceFinder.ca shall not exceed CAD $100.

10. Indemnification

You agree to indemnify, defend, and hold harmless FenceFinder and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the site, your violation of these Terms, or any fence project or agreement between you and a contractor.

11. Termination

We reserve the right to suspend or terminate access to FenceFinder.ca for any user or contractor at any time, with or without notice, for any reason including breach of these Terms. Contractors may also request removal from the network by contacting us.

Upon termination of a contractor's account, Sections 7, 8, 9, and 10 of these Terms survive.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of FenceFinder.ca shall be subject to the exclusive jurisdiction of the courts of Ottawa, Ontario.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of FenceFinder.ca after updated Terms are posted constitutes your acceptance of the new Terms.

For material changes, we will make reasonable efforts to notify active contractors via the email address on file.
